Legal Notice

It is a legal measure taken by a person, establishment, or entity called (the notifying party), based on a law provision or a contractual agreement, against another person or entity called (the notified party) requesting or warning them to perform a certain act or else a legal action or a legal complaint will be filed against them in court should they fail to comply with what is specified in the legal notice within the set time limit.


Importance of Legal Notice:

It is an imperative step that must be taken before filing a legal action or petition for a payment order in an attempt to perform the obligations agreed upon in a contract or a written agreement. It is the first step to settle a dispute between the parties by giving the notified party a chance to fulfill its obligation before resorting to the courts. The legal notice may prescribe a certain action or omission, payment of a sum of money, or fulfillment of a specific right within a specific period, as agreed upon between the parties in the contract or written agreement. Should the notified party fail to implement the requests of payment or performance contained in the legal notice within the period specified by the notifying party, the latter may terminate the contact without referring to the former one, and may take the measures agreed upon between the two parties or resort to the court to compel them to perform the required act, also they may claim compensation for the delay.


Cases where a legal notice must be served

  • • Money claims::  related to the payment of a specified amount of cash, such as commercial papers including cheques, obligations under commercial contract, or debt declarations.

  • • Property related disputes:  : mortgages, service charge, or division of common properties.

  • • Breaches of contract: : execution, termination, or revocation of contracts; and payment of compensation for delay in execution.

  • • Rental disputes: :  termination of lease contracts, eviction of tenants, or payment of rent and ancillary costs.

  • • Applications for declaring bankruptcy and restructure : procedures related to starting protective composition, restructuring liquidations or declaring bankruptcy.

  • • Applications for declaring insolvency : notices to defaulters for settlement of debts, or appointment of a representative on behalf of heirs surviving an insolvent successor.

  • • Notices of handover: for the delivery of a specific asset, e.g. a property, movable asset, grant, …. etc.

  • • Offer and Deposit:  when offering a certain amount of money or a movable property to its owner for receipt, when he rejects to comply, the same will be deposited in the court treasury, or a trustee will be appointed to take care of them.

  • • Employment contract related notices: termination of a contract, deduction from wages, confiscation of any entitlements due to the worker, or others

  • • Notices to employees: :  sending a notice to an employee for breaching the employment contract, violating human resources policies, absenteeism, salary deduction, or others



Requirements for submitting an application for legal notice

  •   Check the Emirates ID number, unified number, or the facility number of the notifying party, noting that there will be reliance on the Government Services Bus “GSB” to extract the contact data and addresses of the parties.

  •   Any claim in the legal notice must be based on an agreement between the parties, whether written or verbal, indicating the nature of agreement and the term.

  •   There should be supporting documents clarifying the relationship between the two parties of the legal notice.

  •   The legal notice must be compatible with the jurisdiction of the judicial system of the Emirate of Abu Dhabi.





Procedures and processes Implementation:

The legal notice follows several steps and stages to be completed until its receipt by the notified party is verified. We list here below these steps:


To submit an application for legal notice, the applicant must register, using their account with the UAE PASS application. The request must be submitted through the official portal of ADJD. To ensure the validity of the request, the legal notice must include the following data:

  • 1. Names of the parties, their personal details, and official approved addresses. To help obtain the parties’ accurate information, the data and addresses of the parties will be automatically extracted from the competent authorities’ system based on the Emirates ID number, unified number or license number.
  • 2. Clarify the claims within the legal notice in a specific and accurate manner. Only claims listed in the e-form will be regarded.
  • 3. Determine the time period for performing the required obligation by the notified party.
  • 4. Attach all documents in support of the claims contained in the legal notice
  • 5. Digitally sign the legal notice through the official portal of the department

To complete the legal notice procedures, fees must be paid through the department’s official website using a credit card.

  • 1.Submission of the application: 300 dirhamم
  • 2.Service of notice: 300 dirhams for each notice

The application is checked by the competent employee in the court, then the notified party is informed whether it has been approved, completed, returned for correction, or rejected with the reasons.

  • 1. The competent employee determines the means of serving the notice to the notified person based on the type of person and priorities for service. Then, fee is determined and an SMS is sent to the applicant’s mobile phone number to pay the notice fee before starting service of notice. In the event that there is more than one party to be notified, multiple SMSs will be sent to pay for each notice separately. In case of non-payment within a period of 3 working days, the status of the application will change to “expired”.
  • 2. Should the service of notice fail using the first method of notification, the competent employee will determine another service method according to the approved order. Then, fee is determined and an SMS is sent to the applicant’s mobile phone number to pay the notice fee. This procedure is repeated until the legal notice is served to the party to be notified..

the legal notice is delivered to the person to be notified, then an SMS is sent to the notifying party indicting the completion of notice service. After which, time is counted to start legal or judicial procedures or to terminate the contract, as long as the time period given in the legal notice is expired without implementing the obligation required from the notified party.



What to do when you receive a legal notice:

In the event that you are served with a legal notice, you can take one of the following actions:

Communicate and negotiate with the notifying party, in an attempt to reach
a settlement and end the dispute without the need to resort to the courts

          Send an official reply to the legal notice
