What are interim orders?

It is an urgent request that is usually decided within one to three working days on a temporary basis, that is, it is temporary until the dispute between the parties is considered, for example, but not limited to (temporary alimony, temporary seizure, vehicle search order, travel ban, surrender of the passport by a party who seized it) and other urgent matters. It was given the name interim order, meaning that the person requesting the order submits a petition explaining  his urgent request and its reasons, then the competent judge issues his order regarding this petition, approving or rejecting the applicant's requests in whole or in part.

 

How do I register a new interim order?

Interim orders are registered through the website of the Abu Dhabi Judicial Department www.adjd.gov.ae which contains samples of claim forms. Cases can also be filed through licensed law firms in the Emirate of Abu Dhabi or through some typing offices, as it is not possible to register files from Mediation and Conciliation Centres directly.

 

What is expected after the order is placed?

You will get the number of the interim order, so, follow up with the competent court, and the decision may be issued without the need to refer to you, or you may be contacted for more information. After the decision is issued, apply for an official copy of the judgment or to affix executory wording, as the case may be, and you will obtain an enforceable decision or the concerned authority is addressed, as the case may be.

 

How to attend the sessions?

In many cases, your presence in such applications will not be required, and if this is required, most of the sessions are held remotely, as you will receive a link to attend remotely, you will be contacted about the necessary arrangements in the event that the competent court decides that your personal presence is needed.


Is there a deadline for implementing the temporary order?

Yes, in the event that the procedures for executing the order are not decided upon, it shall expire within 15 days from the date of its issuance, and a new application may be submitted.


Are there any exceptions to the 30-day time limit for a temporary order?

Yes, there is one exception to it, which is the travel ban. The temporary order issued regarding the travel ban continues to be in effect until the concerned party applies to the court to cancel the same.


What if one of the parties is not satisfied with the decision in the interim order?

The decision issued in the interim order can be objected within the legal period from the date of knowledge of the decision by virtue of an application (grievance against the interim order).


Does an application objecting to the interim order stop it being implemented?

No, much will depend on the timing of the application asking the court to review the order. Where a party has quickly proceeded to execute the interim order, it will stand. However, a judge may order that enforcement be suspended pending consideration of the issues if a party makes the application in time.


​What can the court do as part of considering the review or objection against making an order?

The judge can accept the objection and therefore set aside the interim order either totally or in part.​
