​The ruling was issued, but it contained an ambiguity. As a result, it was difficult to implement what was stated in one or more of the provisions of the ruling. What is the procedure to follow?

You can apply for (the interpretation of judgment) by entering this application. This service allows litigants to request the court to consider a judgment that has been issued because it contains ambiguity that requires an interpretation from the judge.

 

What is a motion for reconsideration?

This service allows litigants to submit a motion against the judgment issued and to reconsider the judgment in specific cases according to the law.

 

What are the cases in which the law permits the submission of an application (Petition for reconsideration)?

1- If a fraud has occurred by the litigant party and has influenced the decision.

2- If, after the judgement is issued, it was based on papers which have been declared as falsified or judged as falsified.

3- If the decision was based on a testimony of a witness and it was judged, after its issue, as perjury.

4- If the petitioner, after issuing the decision, has obtained decisive papers in the case in which his opposing party hindered its submission.

5- If the decision has ruled for matters not requested by the litigants or more than that requested by the litigants.

6- If the wording of the ruling contradicts each other.

7- If the decision was issued against a natural or legal person who was not represented with a valid representation in the lawsuit, except in the case of conventional representation.

8- For those against whom the decision issued in the case is considered evidence and have not been joined or intervened in the case, on condition that the fraud of those who were representing him, his collusion or his flagrant negligence has been evidenced.


What is a motion for omission of claims filed after the issuance of the judgment in the case?

This service allows litigants to request the court to review the judgment issued in order to consider claims that the court neglected to consider as the parties may have submitted requests, but the court did not respond to them, by rejecting or accepting them, and thus it has neglected them.


How can I submit post-judgment motions (e.g., motion for omission of claims, motion for reconsideration, interpretation of judgment)?

This can currently be done  through licensed law firms in the Emirate of Abu Dhabi or through some typing offices.
