What is the Mediation and Conciliation Centre and where is it located?

The Mediation and Conciliation Centre specialises in dealing with civil and commercial disputes, amicably, without fees before referring them to the court. Most civil and commercial cases, such as financial claims, may not be submitted to the court before they are viewed by Mediation and Conciliation Centres. What are the cases that must be presented to Mediation and Conciliation Centres first?

Disputes considered in accordance with Federal Law No. (5) of 2021 amending some provisions of Federal Law No. (17) of 2016.

The centres are obligatorily competent to consider the following civil and commercial disputes: -

  1. Disputes that fall within the value jurisdiction of Minor Chambers in accordance with the provisions of Clause (1) of Article (30) of the Civil Procedures Law and its aforementioned amendments, and the financial claims below (1,000,000) one million dirhams.
  2. Disputes in which both parties are spouses or relatives up to the fourth degree, whatever their value.


What are the cases excluded from the requirement to be presented to Mediation and Conciliation Centres?

The following do not fall within the jurisdiction of the Centres: -

  1. Cases of summary matters and interim orders.
  2. Cases in which the government is a party.
  3. Rent claims considered by rental dispute committees.
  4. Labour lawsuits
  5. Personal status lawsuits
  6. Any other lawsuits decided to be settled before another centre, committee, or entity of similar competence.


How can I register a new file with Mediation and Conciliation?

Mediation and Conciliation files are registered through the website of the Abu Dhabi Judicial Department www.adjd.gov.ae which contains samples of claim forms. Cases can also be filed through licensed law firms in the Emirate of Abu Dhabi or through some typing offices, as it is not possible to register files with Mediation and Conciliation Centres directly.

 

What is expected after registering a file and obtaining the number and date of the session?

Once the file is registered, you will get an appointment for the first session with the conciliator. The number of sessions varies from one case to another until you get  a decision which is either an agreement or the referral of the file to the competent court for consideration.

 

How to attend the sessions?

Most of the sessions are held remotely, as you will receive a link to attend remotely, you will be contacted about the necessary arrangements in the event that the competent court decides that your personal presence is needed.

 

How do I apply for an urgent application pending the consideration of the file?
