Application to file a statement of claim, First Instance - Inheritance Case

This service allows you to obtain a judgment in relation to matters concerning inheritance and disposals arising therefrom such as application for lawful succession notice, determination of heirs' shares, or proof of transfers amongst heirs.

  • Documents Required
  •  Emirates ID (original + copy) or any other proof of identity in exceptional cases    
  •  Copy of the deceased’s passport, family book (for UAE citizens), and the death certificate for claims of lawful notification notice and determination of succession.
  •  For claims related to proof of transfer and assignment, title deed of the assigned property and proof of ownership by the deceased should be submitted, in addition to the family book for applicants of UAE nationality.

  • Fees

  • No fees shall apply to lawful succession notice. 
  • AED 150 for opening an inheritance file 
  • AED 200 for each element of the estate in claims related to determination of heirs' shares (capped at AED 2000)

• Presence of the person concerned or his attorney with an official POA.
• The statement of claim must clearly include litigants' information, details, and addresses.
• Applicant shall have the capacity to act.
